Illinois Gun/Magazine/Registration Bills

gunbansThe Senate Public Health Committee passed both HB0815 (Large Capacity Magazine & Shooting Range Licensing Bill) and HB1263 (Semi-Automatic Weapons Ban).

Below is an overview of the bills (There are several amendments that I have not reviewed yet):

HB0815

  • Goes into affect 1/1/2014
  • All Shooting Ranges must be Licensed by the Illinois State Police, exempts private clubs
  • Shooting ranges my continue to purchase large capacity magazine, but must register them and can only rent them for use at the range
  • Nobody can fire a weapon at a range without a FOID card
  • Bans all magazines that hold more than 10 rounds
  • Grandfathered all owners of large capacity magazines
    • Must register magazines with State Police within 90 days
    • Can only transfer to an heir or FFL dealer
  • Must report lost or stolen large capacity magazines within 72 hours of knowledge

HB1263

  • Goes into affect 7/1/2013
  • All Shooting Ranges must be Licensed by the Illinois State Police, exempts private clubs
  • Shooting ranges my continue to purchase large capacity magazine, but must register them and can only rent them for use at the range
  • Nobody can fire a weapon at a range without a FOID card
  • Grandfathered all owners of current guns
    • Must register banned guns with State Police within 90 days
    • Can only transfer to an heir or FFL dealer
  • Bans semi-automatic weapons [Defined as]
    • .50 caliber rifles, and .50 caliber cartridges.
    • any of the firearms or types, replicas, or duplicates in any caliber of the firearms, known as:
      • Norinco
      • Mitchell
      • Poly Technologies
      • Avtomat Kalashnikovs (all models)
      • Action Arms Israeli Military Industries; UZI and Galil
      • Beretta AR-70 (SC-70)
      • Colt AR-15
      • Fabrique Nationale FN/FAL, FN/LAR, and FNC
      • SWD M-10, M-11, M-11/9, and M-12
      • Steyr AUG
      • INTRATEC TEC-9, TEC-DC9, and TEC-22
    • any shotgun which contains its ammunition in a revolving cylinder, such as (but not limited the Street Sweeper and Striker 12
    • Semi-automatic rifle or pump-action rifle that can accept a detachable magazine or the following:
      • folding or telescoping stock
      • pistol grip or thumbhole stock
      • shroud that is attached to, or partially or completely encircles the barrel
    • Semi-automatic pistol that has an ability to accept a detachable magazine and has any of the following:
      • folding, telescopingor thumbhole stock
      • shroud that is attached to, or partially or completely encircles the barrel
      • ammunition magazine that attaches to the pistol outside of the pistol grip
      • manufactured weight of 50 ounces or more  when the pistol is unloaded
    • Semi-automatic version of an automatic firearm
    • Semi-automatic rifle or pistol with a fixed magazine that has the capacity to accept more than 10 rounds of ammunition
    • semi-automatic rifle or a pistol with the capacity to accept a detachable magazine, a muzzle brake, or muzzle compensator
    • semi-automatic shotgun with any of the following:
      • folding or telescoping stock
      • a pistol grip or thumbhole stock
      • ability to accept a detachable magazine
      • Fixed magazine capacity in excess of 5 rounds
    • Exempts firearms
      • manually operated by bolt, pump, lever, or slide action
      • inoperable
      • antique
      • rifle with a fixed tubular magazine located under the barrel that is only capable of holding rounds of ammunition placed end to end
      • Air Rifles
      • Olympic Shooting sport rifles

    Incredible that our politicians have time to craft a very complex bill (HB1263) that goes into minute details about banned weapons, yet cannot find time to address the pension situation that is killing the state.

    There seems to be so many unconstitutional parts of this it is mind boggling. How can they ban guns, when the courts told them to come up with a conceal carry within 180 days, because their conceal carry ban is unconstitutional?

    Plus, I’m still waiting on the outrage of the 500+ murders in Chicago in 2012, and getting THOSE weapons away from the thugs. Instead they target law abiding citizens. Unbelievable.

    All these “Weapon” laws are and will be meaningless under the US Constitution and are worthless actions against the gun crimes and criminals obtaining weapons. It is astounding to see the legislature waste time on things that are not priorities of a bankrupt operation. Nor are they addressing their bloated operations and excessive compensation levels and millionaire pension plans. This truly epitomizes a dying culture where mental illness, incompetence and corruption has reached epidemic levels. Maybe the problem is that these people are a product of our Public Education System and cannot Read. It truly is remarkable how perceptive our Forefathers were in enacting a Constitution that addresses many of the facets of tyranny that Governments tend towards. Unfortunately when corruption has reached epidemic levels like here there is no Judicial System to address the crimes of the Public Sector and the Government.

    These bills wont pass. If by some stretch of normal thinking they do pass, they will quickly be deemed unconstitutional by the Illinois court of appeals, the same court that struck down the conceal carry ban. Now ask your state official why they waste time and money on this type of crap instead of working on the public good. I think that is why they were elected. Anyone who’s name is on the yea vote should be removed, or at least replaced come next election. We won’t forget who you are.

    Good summary. I was shocked at the shroud exclusion for pistols- every non-revolver uses a racking slide. That makes every handgun made by Glock illegal for a private citizen to own.
